Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of these Terms and Conditions:
- Include all definitions from our base Terms and Conditions, except where a conflicting definition is listed below.
- Account means a unique account created for You to access our Service or parts of our Service.
- Battery Management System means the hardware designed to protect and monitor the High Voltage Battery Pack. Specifically, within this document, refers to Tesla’s Battery Management System within the High Voltage Battery Pack.
- Battery Modules means groups of battery cells built into a physical structure of which multiple units make up the High Voltage Battery Pack. For an example, see https://057tech.com/products/battery_modules
- Battery Monitoring Device means device which is attached to Your vehicle for purposes of monitoring the high voltage battery pack and reporting this information to 057 Technology.
- BMD means Battery Monitoring Device (see Battery Monitoring Device).
- BMS means Battery Management System (see Battery Management System).
- CAN means Controller Area Network, and is generally a communication mechanism that allows digital interface with electronic modules within a vehicle.
- Degradation means the difference between the High Voltage Battery Pack’s usable energy capacity now versus the usable energy capacity when it was new (or at some other point in the past), generally caused by normal wear and tear, that is not the result of a component failure. (Software changes by Tesla are not component failures.)
- Fast Charging means DC charging of the High Voltage Battery Pack, possibly including Supercharging.
- High Voltage Battery Pack means the main high voltage traction battery pack of the electric vehicle as a whole unit, not including components not physically within the enclosure of the unit.
- HV means high-voltage.
- Service Plan means these terms and conditions, combined with a Your paid invoice for purchasing the same.
- Supercharging/Supercharger mean Tesla’s proprietary DC fast charging network and equipment.
- VIN means Vehicle Identification Number.
- You/Your means the individual accessing, purchasing, or using the Service, or the company, or other legal entity on behalf of which such individual is accessing, purchasing, or using the Service, as applicable.
Acknowledgment
These are the Terms and Conditions governing the use of the Service Plan and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service Plan.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.
By accessing, purchasing, or using the Service Plan You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service. Your disagreement with these Terms and Conditions do not invalidate the Your obligations under an existing Service Plan. Your remedy for any disagreement is your right to cancellation as outlined in the cancellation section of these terms.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
These service plan terms are in addition to our company's general Terms and Conditions. Our general Terms and Conditions form a part of these Service Plan terms. If a conflict exists between the general Terms and Conditions and these Service Plan Terms and Conditions, these terms take precedence.
General Terms and Description
The Service Plan covers failures of components internal to the High Voltage Battery Pack while the Service Plan is active. Examples include, but are not limited to: Battery Modules, BMS components, fuses, contactors, and the high voltage current shunt. Exclusions and restrictions apply. See the Exclusions section and the rest of these terms for details.
This Service Plan is intended to cover one vehicle and one associated High Voltage Battery Pack. This Service Plan is not transferable to other vehicles or High Voltage Battery Packs. The Service Plan may be transferred to other vehicle owners by You, as outlined in these Terms and Conditions.
Any issue or failure of the High Voltage Battery Pack that existed or occurred prior to the installation of the Battery Monitoring Device is not covered under this Service Plan under any circumstances. In general, this Service Plan is intended to cover most failures of the High Voltage Battery Pack that would normally be covered by Tesla’s OEM High Voltage Battery Pack warranty, after the OEM warranty has expired, during the active term of this Service Plan.
To qualify for repairs or replacements under this Service Plan, the vehicle must be continuously equipped with the Battery Monitoring Device. The Battery Monitoring Device will assess the health of the High Voltage Battery Pack and determine if the vehicle qualifies for coverage under this Service Plan.
Transferring the Service Plan
This Service Plan is an agreement between 057 Technology and the vehicle's owner at the time of purchase. The Service Plan is transferable to a new owner with authorization from 057 Technology and such an authorization shall not be unreasonably withheld except for:
- If the vehicle’s High Voltage Battery Pack no longer qualifies within the terms of this Service Plan; or
- This Service Plan has expired or would expire within 30 days of the transfer request.
There is no cost to transfer the Service Plan to a new Owner.
Service Plan Coverage Term
Starting Coverage
This Service Plan’s coverage term does net begin until ALL of the following have occurred successfully:
- Your vehicles OEM High Voltage Battery Pack warranty has expired; and
- You purchase and pay for this Service Plan; and
- The Battery Monitoring Device in your vehicle (by you, a third party, or 057 Technology); and
- The Battery Monitoring Device qualifies the High Voltage Battery Pack and reports this data back to 057 Technology.
For clarification: This Service Plan does NOT take effect until AFTER the OEM High Voltage Battery Warranty has expired, and the countdown clock and odometer meters on the Service Plan won’t start until after the OEM High Voltage Battery Warranty expires. The coverage under this Service Plan (except for the monitoring services covered by the Battery Monitoring Device) do not overlap with the OEM High Voltage Battery Warranty.
057 Technology will make every effort to ensure that relevant dates are accurate, including your OEM warranty expiration date. If any adjustments are needed, please contact us BEFORE purchasing this Service Plan.
Ending Coverage
This Service Plan ends and is voided and no longer covers the High Voltage Battery Pack when any of the following occur:
- You cancel this Service Plan; or
- Your vehicle is disqualified from coverage for any of the excluded reasons listed in these terms; or
- 057 Technology cancels this service plan under the lost Battery Monitoring Device fee terms; or
- The calendar term of the Service Plan expires; or
- The permitted mileage of the Service Plan is exceeded
Details relating to the calendar and mileage terms will be on 057 Technology’s copy of the invoice for the Service Plan. Details about the Service Plan’s activation will be provided to You in your Account on 057 Technology’s website.
057 Technology’s records will be the records of note for any information related to the Service Plan.
If you disagree with any metrics or dates utilized by 057 Technology for the sale or service of this Service Plan, please contact us. If still not satisfied, your remedy is your right to cancel as outlined in these terms.
Repairs/Replacements/Claims
To be considered for repair or replacement under this service plan, the High Voltage Battery Pack must fail.
Failures of the High Voltage Battery Pack must cause the vehicle to be unusable for normal general use purposes. This would include, as the result of a High Voltage Battery Pack related issue only: the inability to drive, inability to charge, inability to Fast Charge, loss of a significant usable portion of normal range (that is not the result of Degradation), uncorrectable cell imbalance, welded contactors, etc.
057 Technology has full discretion in determining what constitutes a failure of the High Voltage Battery Pack, since many unrelated issues in other components can present to the user similarly.
All repairs or replacements will be at 057 Technology's sole discretion, and the determination of what is necessary for a repair (be it a repair or replacement) will be at 057 Technology's sole discretion. Repairs and replacements are intended to bring the High Voltage Battery Pack back to normal operation. Repairs are replacements are not intended to, nor can they, restore capacity or range loss that results from Degradation. Some repairs which bring the vehicle back to normal operation may result in a small amount of capacity or range loss. High Voltage Battery Pack replacements may not always have the exact same capacity or performance of the original High Voltage Battery Pack, however 057 Technology will make every effort to match any replacement High Voltage Battery Pack with capacity and performance equal to or greater than that of the original High Voltage Battery Pack (at a point prior to the related failure).
At 057 Technology's discretion, replacement High Voltage Battery Pack may be non-OEM components, including components produced and manufactured by 057 Technology, provided the performance and capacity of the replacement High Voltage Battery Pack is comparable to the original High Voltage Battery Pack.
Failures of components other than the High Voltage Battery Pack are not covered by this agreement, and 057 Technology is not obligated to repair or replace components outside of the High Voltage Battery Pack even if repair or replacement of such components are required to get the vehicle back to normal operation. 057 Technology can repair and replace most Tesla vehicle components as a customer-pay service. 057 Technology will advise You of any such issues if we become aware of them as they arise and allow You to decide how to proceed.
Requesting a Repair/Replacement
The Battery Monitoring Device will generally alert You and 057 Technology to the need for a repair or replacement, allowing 057 Technology to assess the nature of the failure.
If You feel there has been a failure of the High Voltage Battery Pack that has NOT been detected by the Battery Monitoring Device, you must contact us immediately so that we can assess the health of the High Voltage Battery Pack as soon as possible.
Once 057 Technology assesses the nature of the High Voltage Battery Pack failure and determines that the failure is covered by this service plan, 057 Technology will advise the You that the vehicle must be brought for service. 057 Technology can assist You with arrangements to get the vehicle to 057 Technology's facility, if desired. 057 Technology will then repair or replace the High Voltage Battery Pack to bring the High Voltage Battery Pack back to normal operation.
Arrangements for service under this Service Plan must be made within the covered Service Plan period, OR within 90 days of 057 Technology’s assessment of a covered failure, whichever gives You the longer time frame. The actual scheduled date for service does not have to be within this time frame, provided the arrangements are made within the allotted time. If arrangements are not made as required above, through no fault of 057 Technology, then this Service Plan will be considered completed and expired, and no service will be performed under this Service Plan.
Where Service Must Occur
All repairs or replacements MUST be performed by 057 Technology at an 057 Technology facility with the full vehicle present.
057 Technology is under no obligation whatsoever to facilitate any repair or replacement that is not to be performed by 057 Technology at an 057 Technology facility.
057 Technology is not responsible for any costs incurred by You related to vehicle service.
057 Technology is not responsible for costs or logistics related to transport of a vehicle to or from an 057 Technology facility.
057 Technology will, as it is able to and at its sole discretion, assist You with transport arrangements for a vehicle to or from an 057 Technology facility. Unless otherwise specified, all transport costs are at Your expense.
After a Repair/Replacement
In the event 057 Technology replaces the High Voltage Battery Pack under this Service Plan, the original High Voltage Battery Pack becomes the sole property of 057 Technology.
You warrant that You own the original High Voltage Battery Pack and further that You have the right to transfer ownership of the High Voltage Battery Pack to 057 Technology as required under this Service Plan.
Replacement High Voltage Battery Packs will continue to be serviced under this Service Plan until its original expiration, provided the Battery Monitoring Device remains installed as required by the terms of this service plan. No additional warranty is provided on replacement High Voltage Battery Packs except as otherwise stated in the documentation of a non-OEM replacement High Voltage Battery Pack.
Replacement High Voltage Battery Packs installed by 057 Technology automatically pass initial Battery Monitoring Device qualification requirements for continued coverage under this plan.
If a High Voltage Battery Pack is replaced under this Service Plan, You may, at your option, renew this Service Plan to have terms equal to any Service Plan offered for your vehicle at the time of replacement at a pro-rata rate based on whichever term (mileage or time) has the least remaining. (Informational note only: For example, if you have 9 months left on the Service Plan, and 057 Technology is offering a new-signup 2 year plan for your vehicle for $1,999, you would pay for 15 months at that rate, or $1,249.38, to bump the term of your plan to 2 years from the replacement.)
Exclusions and Other Terms
Vehicles with High Voltage Battery Packs installed by anyone other than Tesla or 057 Technology are not qualified under this service plan. Vehicles with non-original High Voltage Battery Packs, refurbished High Voltage Battery Packs, and High Voltage Battery Packs with labeled capacities differing from the vehicle's original trim are not automatically covered, but can be covered upon request and at 057 Technology's sole discretion.
The inability to achieve any specific performance, range, charging rates, etc are not covered by this Service Plan in any way except as otherwise outlined in these Terms and Conditions.
This service plan will not cover any type of failure of the High Voltage Battery Pack that would not have been covered under the vehicle's original OEM High Voltage Battery Pack warranty. This service plan also does not cover the replacement of a High Voltage Battery Pack that has suffered damage from fire, even if that fire is somehow thought to be the fault of the High Voltage Battery Pack. This service plan will not cover failures of the High Voltage Battery Pack resulting from, directly or indirectly, any of the following (including but not limited to):
- Accidents, collisions, or objects striking the vehicle;
- Any repair, alteration or modification of the vehicle which alters the behavior of the High Voltage Battery Pack (performance enhancement, charging enhancement, etc);
- Improper repair or maintenance;
- Any damage to your vehicle's hardware or software, or any loss or harm to any personal information/data uploaded to your vehicle resulting from unauthorized access to vehicle data or software from any source, including non-Tesla parts or accessories, 3rd party applications, viruses, bugs, malware, or any other form of interference or cyber attack;
- Towing; Includes damaged caused by physically towing the vehicle, or damaged caused by using the vehicle for towing other than as permitted by the OEM;
- Improper winch procedures;
- Theft, vandalism, or riot;
- Fire, explosion, earthquake, windstorm, lightning, hail, flood, or deep water;
- Driving off-road;
- Driving over uneven, rough, damaged or hazardous surfaces, including but not limited to, curbs, potholes, unfinished roads, debris, or other obstacles, or in competition, racing or autocross or for any other purposes for which the vehicle is not designed;
- Overloading the vehicle;
- Using the vehicle as a stationary power source;
- The environment or an act of God, including, but not limited to, exposure to sunlight, airborne chemicals, tree sap, animal or insect droppings, road debris (including stone chips), industry fallout, rail dust, salt, hail, floods, wind storms, acid rain, fire, water, contamination, lightning and other environmental conditions.
- Damaging the High Voltage Battery Pack, or intentionally attempting, either by physical means, programming, or other methods, to extend (other than as specified in your owner documentation) or reduce the life of the High Voltage Battery Pack;
- Exposing the High Voltage Battery Pack to direct flame;
- Flooding the High Voltage Battery Pack;
This Service Plan shall be voided with no refunds, exchanges, payments, credits from 057 Technology or with any liability to provide further services, at 057 Technology's sole discretion, should any of the following apply, including but not limited to:
- Vehicles that have had the VIN defaced or altered or the odometer or other related system disconnected, altered or rendered inoperative so that it is difficult to determine the VIN number or actual mileage;
- Vehicles that have been designated, labeled or branded as dismantled, fire-damaged, flood damaged, junk, rebuilt, salvage, reconstructed, irreparable, or a total loss;
- Vehicles that have been determined to be a total loss by an insurance company;
- The Battery Monitoring Device is disconnected from the vehicle for an extended period, or the vehicle no longer qualifies upon re-install;
- The Battery Monitoring Device is altered, tampered with, or otherwise modified or attempted to be modified;
- The High Voltage Battery Pack is removed, replaced, altered, modified, reprogrammed (except for standard production releases of Tesla firmware in a forward direction to a newer version than what is currently installed on the components)
- Any action, intentional or not, which prevents the Battery Monitoring Device from getting real, proper, correct, and direct readings, responses, data, communication, etc from the vehicle's High Voltage Battery Pack, including but not limited to: CAN interception or spoofing; alterations to the CAN bus, physically or electronically, which prevent direct communication between the Battery Monitoring Device and the High Voltage Battery Pack; overloading the CAN bus; injecting data on the CAN bus; etc;
- Vehicles that have been exported from North America, except permitted in writing;
Exception to the above: Should a vehicle become totaled, salvaged, or otherwise destroyed during the coverage period, You are entitled to a pro-rata refund for the Service plan calculated from the request time to the end of the plan term. Pro-rata refunds are also subject to the refund terms outlined in these Terms and Conditions.
Service Plan coverage for vehicles which deviate from any of the listed exclusions must be pre-approved in writing from 057 Technology. Failure to acquire written approval prior to a Service Plan-voiding action will be considered Your intention to void this Service Plan with no refunds, exchanges, payments, or credits from 057 Technology or with any liability for 057 Technology to provide further services under this Service Plan.
Removal of, modification of, or tampering with the High Voltage Battery Pack during the covered period by non-057 personnel voids this Service Plan.
Removal of the high voltage battery by non-Tesla or non-057 personnel voids this Service Plan, regardless of if the Service Plan has taken effect yet or not.
If the High Voltage Battery Pack is removed by Tesla during the OEM warranty coverage period, after purchase of this Service Plan, and period before this Service Plan takes effect, then the High Voltage Battery Pack must be requalified by the Battery Monitoring Device before this Service Plan is activated. Your cancellation rights continue to apply.
To qualify for repairs or replacements under this Service Plan, the vehicle must be continuously equipped with the Battery Monitoring Device, unless otherwise actived by 057. The Battery Monitoring Device will assess the health of the High Voltage Battery Pack and determine if the vehicle qualifies for coverage under this Service Plan. If your vehicle does not qualify for coverage, you may cancel the Service Plan.
Any failure of the High Voltage Battery Pack that occurs while the Battery Monitoring Device is not actively monitoring the High Voltage Battery Pack will NOT be covered under this Service Plan, and any such failure voids coverage under this Service Plan, unless otherwise activated by 057.
Unless explicitly permitted in writing noting the specific VIN, High Voltage Battery Pack part number, and High Voltage Battery Pack serial number, COVERAGE DOES NOT BEGIN until AFTER the Battery Monitoring Device is installed and completes its assessment of the High Voltage Battery Pack AND that assessment shows that the High Voltage Battery Pack is in good condition. 057 may activate a service plan in the absence of a Battery Monitoring Device, at our discretion, 8 weeks after purchase. With no Battery Monitoring Device, pack health will be determined by other means (vehicle logs, BMS logs, etc) if a failure occurs. What qualifies as “good condition” is at 057 Technology's sole discretion, but generally would include batteries that are fully functional in the vehicle with no errors present and no major imbalances, among other things.
Cancellations and Refunds
You may cancel this Service Plan at any time and for any reason, subject to the terms below.
Cancellation requests must be made via email to contact@057tech.com and include your VIN and Invoice number. Cancellations may require that You electronically sign a cancellation form. Cancellation requests received by any other method may not be processed.
Cancellations require the return of the Battery Monitoring Device to 057 Technology, in good working condition, regardless of the reason for cancellation. If the Battery Monitoring Device has been lost, damaged, destroyed, or is otherwise not returnable, You are responsible for a fee, as redundantly outlined in the Battery Monitoring Device section, of $400 fee to cover the replacement cost of the Battery Monitoring Device. If this fee is assessed, and a refund is calculated to be greater than or equal to the cost of the fee, this fee will be deducted from the refund. If this fee is assessed, and the refund is less than the cost of the fee, then You will not receive a refund AND You are responsible for paying the difference between your Service Plan refund amount and the $400 fee. 057 Technology may waive this fee, at their sole discretion, but is under no obligation to do so. If the Battery Monitoring Device has not yet shipped at the time of cancellation, this paragraph does not apply. (See the section below on the Battery Monitoring Device for details about the Battery Monitoring Device.)
If Your vehicle does not initially qualify for coverage under this Service Plan as the result of a disqualification by the Battery Monitoring Device, you are entitled to cancel and receive a refund under these terms. The Service Plan will not have been considered active and no portion of the term has been used.
If the Service Plan has been activated, and your vehicle does not qualify for coverage under this Service Plan due to a failed requalification after a Battery Monitoring Device removal or High Voltage Battery Pack removal (see the section below on the Battery Monitoring Device), then You may cancel Your Service Plan and receive a pro-rata refund for the remaining term of Your Service Plan as outlined below.
If the Service Plan has been activated, all refunds are pro-rata of the remaining term of the Service Plan, minus a processing fee of 10% as permitted by North Carolina law, calculated using time remaining or miles remaining, whichever calculation results in a lowest refund amount, subject to the rest of these Terms and Conditions.
If your Service Plan has not been activated, refunds are for the full amount paid, subject to the rest of these Terms and Conditions.
All refunds are based on the actual amount paid, including any applicable discounts.
The normal value of any work performed under this service plan will be deducted from any refund, and this deduction may reduce the amount of a refund to zero.
All refunds will be processed within 30 days of the request, or within 30 days of the receipt of the returned Battery Monitoring Device, whichever is later.
Refunds can be in the form of a refund to your original credit card, a business check, wire transfer, or cash (US Dollars) at 057 Technology’s discretion. In lieu of these methods, refunds can be converted to store credit, at Your sole discretion, towards other products or services offered by 057 Technology (such as a non-covered High Voltage Battery Pack replacement or repair), upon request. Refunds in any other form may be permitted if agreed upon by both You and 057 Technology.
Battery Monitoring Device
General Information
A Battery Monitoring Device is required to be installed in the vehicle to which this Service Plan applies.
The Battery Monitoring Device is the property of 057 Technology and must be returned upon expiration, cancellation, or voiding of this service plan. The Battery Monitoring Device must also be returned upon request of 057 Technology.
The Battery Monitoring Device collects data related to the High Voltage Battery Pack and securely reports this information back to 057 Technology periodically. 057 Technology is under no obligation or responsibility to provide this data to You, and You further agree that 057 Technology may collect this data and use it for whatever purposes 057 Technology deems appropriate.
You are responsible for ensuring that the Battery Monitoring Device remains connected, powered, and communicating at all times, and responding to any requests from 057 Technology regarding the operation and reporting of the Battery Monitoring Device in a timely manner.
Some variants of the Battery Monitoring Device require linking with an internet-connected smartphone or tablet periodically via Bluetooth, WiFi, or other means to ensure data is properly uploaded to 057 Technology. You agree to facilitate this as required for the proper operation of the Battery Monitoring Device.
You are responsible for the installation of, and any required maintenance of, the Battery Monitoring Device. If practical, You can bring your vehicle to an 057 Technology facility for an 057 technician to install the Battery Monitoring Device at no charge, subject to scheduling approval.
Lost/Stolen/Damaged Battery Monitoring Device
If the Battery Monitoring Device is lost, stolen, damaged, or is otherwise not able to function due to no fault of 057 Technology, then You are responsible for a $400 replacement fee for a replacement Battery Monitoring Device. This fee is to replace the original Battery Monitoring Device owned by 057 Technology and the replacement Battery Monitoring Device is still the property of 057 Technology.
If the Battery Monitoring Device is not able to be returned, as required by these terms, due to it being lost, stolen, damaged, or otherwise unable to be returned, You are responsible for a $400 fee to cover the non-return of the Battery Monitoring Device.
If a fee is assessed related to the Battery Monitoring Device, 057 Technology may collect this fee by any reasonable means, including deducting from a customer-initiated cancelation refund, invoicing, third party collection, or by forcing cancellation of this Service Plan if the pro-rata refund, as calculated in the Cancellations and Refunds section of these terms, would be less than or equal to the fee. 057 Technology can enact this cancellation provision at any time the fee is unpaid and the above conditions permitted cancellation are met, at its sole discretion, even if that cancellation occurs some time after the initial assessment of the fee. If the Service Plan is cancelled under this paragraph, 057 Technology reserves the right to collect any unpaid portion of the fee.
057 Technology is not obligated to waive or refund any fee paid for a replacement Battery Monitoring Device, even if the device is subsequently found and returned.
Restrictions
Third party passive CAN monitoring devices are permitted to be utilized in conjunction with the Battery Monitoring Device as long as these devices do not interfere with the operation of the Battery Monitoring Device. Third party CAN devices which transmit on the CAN bus are prohibited. The use of third party CAN devices which transmit on the CAN bus can void this Service Plan, at 057 Technology's sole discretion, even if the device's intended purpose has nothing to do with the High Voltage Battery Pack.
057 Technology is not responsible for facilitating the use of third party devices in conjunction with the Battery Monitoring Device.
Liability and Obligations
057 Technology will make good faith efforts to fulfill service requirements under this Service Plan to the best of their ability. In the event of a dispute, 057 Technology's maximum liability under this Service Plan is the actual price paid for the Service Plan by You.
In the event of a payment dispute of any kind (chargeback, for example) all of 057 Technology's obligations under this service plan shall be void. 057 Technology does not tolerate fraud of any kind. If a payment dispute arises after service is performed under this service plan, You are liable for the full value of the service performed (up to $40,000, depending on the exact replacement components).
This Service Plan is for services by 057 Technology which meet the conditions described in these terms. Services under this Service Plan will be performed by 057 Technology and/or its affiliates, at 057 Technology’s sole discretion. Services under this Service Plan are required to be performed at an 057 Technology facility. 057 Technology is not obligated to perform services at any other location.
This Service Plan in no way and under no circumstances grants any right to any reimbursement for repairs or services of any kind. 057 Technology will never make payments to any third party for coverage under this Service Plan. 057 Technology will never make payments to You for coverage under this service plan (except for refunds for cancellations as described herein). This Service Plan does NOT grant You any rights whatsoever to any payments from 057 Technology for any reason (except for refunds for cancellations as described herein). These provisions do not restrict 057 Technology from making arrangements with third parties or with You that involve payments from 057 Technology (such as offers to purchase Your vehicles).
057 Technology’s obligations for the repair and replacement of a covered High Voltage Battery Pack are only valid once the Battery Monitoring Device's assessment has been made, the vehicle qualifies, AND the vehicle's OEM High Voltage Battery Pack warranty has expired.
If an issue occurs while this plan is pending activation, the Battery Monitoring Device is installed, AND the vehicle is still covered by its OEM High Voltage Battery warranty, then 057 Technology, at their discretion, can assist You with pursuit of a warranty replacement or service with Tesla by providing relevant information from the Battery Monitoring Device to Tesla directly or by speaking with Tesla on Your behalf, if requested by You.
057 Technology is not obligated to sell Service Plans, and may reject requests for sale of a Service Plan to any one for any reason.
Governing Law
This Service Plan is a “Service Contract” sold by 057 Technology, LLC, a North Carolina Limited Liability Corporation.
057 Technology, LLC’s sole business presence is in Catawba County in the State of North Carolina, and all sales and services (including this Service Plan) shall be construed, governed, and enforced by and in accordance with the laws of the State of North Carolina. Each party expressly consents to and agrees that this Service Plan is subject to the sole jurisdiction of the Catawba County Court in North Carolina.
Other Notes and Provisions
Fast Charging Notes
Repairs and replacements of High Voltage Battery Packs by 057 Technology do not affect the vehicle’s permission to Supercharge or Fast Charge. The vehicle will continue to benefit from whatever provisions are in place regarding Supercharging for that vehicle (for example, Free Lifetime, Paid, Free for First Owner, etc). 057 Technology will not modify this setting on the vehicle.
Supercharging accessibility, as well as Fast Charging speeds and performance are outside of the control of 057 Technology. We are not responsible for any changes to Supercharging or Fast Charging made by Tesla or other third parties.
High Voltage Battery Pack replacements from 057 Technology under this plan are targeted to have as good or better Fast Charging performance as the original battery pack.
Upgrades Without a Failure
While covered by the Service Plan, or while the Service Plan is not yet active due to an existing OEM High Voltage Battery Warranty you may be able to get a discount from 057 Technology on an opt-in customer-pay High Voltage Battery Upgrade, provided the Battery Monitoring Device is installed and operational and your current battery pack is in good condition. The term of this Service Plan can continue with the upgraded battery pack. Contact us for more information.
Upgrades After a Failure
If your vehicle requires a replacement High Voltage Battery Pack as part of a covered service under this Service Plan, you may be eligible for a discount on a customer-pay High Voltage Battery Upgrade. Contact us for more information at that time.
Getting Your Vehicle to 057 Technology for Service
If your vehicle needs service under this Service Plan, it is your responsibility to get your vehicle to an 057 Technology facility.
Informational note only: 057 Technology works with vehicle carriers around the country and around the world and regularly ships vehicles with many different carriers. We can help arrange vehicle transport to/from our facilities at costs much lower than an individual can find elsewhere to keep any potential vehicle transport costs as low as possible for you in the event service is needed.
